ORDINANCE NO. 795

AN ORDINANCE OF THE COLUSA COUNTY BOARD OF SUPERVISORS ADOPTING A CEQA CATEGORICAL EXEMPTION AND AMENDING COUNTY ZONING MAPS TO REZONE A 10.08+/- ACRE SITE TO HIGHWAY SERVICE COMMERCIAL ZONING AND A 10.08+ SITE TO HEAVY INDUSTRIAL ZONING  

The Board of Supervisors of the County of Colusa ordains as follows:

SECTION 1.

This ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14, Division 6, Article 19, section 15305 (Minor Alterations in Land Use Limitations)  because the subject sites have an average slope of less than 20% and will not result in any changes in land use or density given that the proposed application is simply swapping the land use designations of two identically sized portions of property that are immediately adjacent to each other and would not result in any changes to the development potential of the area or new impacts no previously analyzed.

SECTION 2.

The official zoning maps of Colusa County are amended to change the zoning designation for a 10.08+/- acre portion of APN: 011-280-015 from Heavy Industrial (M-2) to Highway Service Commercial (C-H) and change the zoning designation of a 10.08+/- acre portion of APN: 011-280-040 from Highway Service Commercial (C-H) to Heavy Industrial (M-2) as shown below:

SECTION 3.

The provisions of this ordinance are severable and if any provision or its application in a particular circumstance is held invalid, the remainder of the ordinance amendment, including the application of such part or provision in other circumstances, shall not be affected and shall continue in full force. The Board of Supervisors declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase in this ordinance irrespective of the fact that any one, or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases may be held unconstitutional, invalid or unenforceable.

SECTION 4.

This ordinance shall become effective thirty (30) days after its passage. It shall be published once with the names of the members of the Board of Supervisors voting for and against the ordinance in a newspaper of general circulation published in the County of Colusa, State of California, within fifteen (15) days after its passage.

Introduced and passed at a regular meeting of the Board of Supervisors held on the 30th day of October, 2018 by the following roll call vote:

AYES:   Supervisors John D. Loudon, Kent S. Boes, and Gary J. Evans.

NOES:   None.

ABSENT:   Supervisor Denise J. Carter.
