Otterson offered plea deal by district attorney

The former Stonyford resident accused of unlawfully killing two cows on Leesville-Lodoga Road was offered a plea deal by the Colusa County District Attorney’s Office in court last week.

Tucker Michael Otterson, 28, now a resident of Oregon City, OR, appeared in Colusa County Superior Court on Wednesday for the setting of his preliminary hearing. The preliminary hearing and time were waived as Otterson weighs whether to take the plea agreement or not. Otterson’s case will now be referred to Colusa County Probation, who will complete a pre-plea report for his next court date, scheduled for Nov. 15.

In exchange for Otterson pleading guilty to one felony charge of grand theft, the Colusa County District Attorney’s office is offering to dismiss all but one of the seven other charges against him on a Harvey Waiver. A Harvey Waiver allows the court to consider the dismissed charges during sentencing. Colusa County District Attorney Matthew Beauchamp said that it will also allow for the payment of restitution for damages incurred by the owners of the cows.

Otterson was initially charged with two counts of felony cruelty to an animal, one of which included an enhancement for use of a firearm, felony grand theft for stealing the head of one of the animals, along with two misdemeanor charges of vandalism of private property, misdemeanor hit and run, and misdemeanor obstructing or delaying a peace officer.

If Otterson agrees to take, and the presiding judge agrees to accept, the plea agreement offered by the Colusa County District Attorney’s Office, Otterson could serve up to a year in jail, likely in the county. As a convicted felon, Otterson would be barred from owning or possessing firearms for any purpose. He previously received a lifetime ban from hunting by the California Department of Fish and Wildlife following a previous incident involving alleged animal cruelty and the unlawful take of game animals.
