You have 30 CALENDAR DAYS after this summons and legal papers are served on you to file a written response at this court and have a copy served on the plaintiff. A letter or phone call will not protect you. Your written response must be in proper legal form if you want the court to hear your case. There may be a court form that you can use for your response. If you cannot pay the filing fee, ask the court clerk for a fee waiver form. If you cannot afford an attorney, you may be eligible for free legal services from a nonprofit legal services program. A. * “All Interested Persons” refers to all persons who are interested in the matter of McCullough, et al., v. Colusa Groundwater Authority, et al., Colusa County Superior Court Case No. CV 24410 (the “Reverse Validation Action”) and generally includes all owners of parcels of real property and all local agencies located within the boundaries and jurisdiction of the Colusa Groundwater Authority (the “CGA”), who are subject to the Operations Fees established by the CGA, upon its adoption of Resolution No. 2019-02, at its regularly scheduled meeting on June 5, 2019.

B. Continuation of PLAINTIFFS:
and as Trustee of the Meredith Frank and Voleata V. McCullough Family Revocable Trust, Exemption and Survivor’s Trust, dated January 17, 2003; RICHARD PAUL BARTHELS, individually and as Trustee of the Richard Paul Barthels and Jeanmarie McCullough Family Revocable Trust dated September 19, 2017; BONNIE JILL NEELY and REBECCA LOUISE GOODMAN, individually and as Trustees of the Meredith Frank and Voleata V. McCullough Family Revocable Trust, Exemption and Survivor’s Trust, dated January 17, 2003,

C. NOTICE TO DEFENDANTS OF TIME TO FILE WRITTEN RESPONSE:
1. Defendant COLUSA GROUNDWATER AUTHORITY must respond within thirty (30) days of personal service of this Amended Summons and the Complaint to Invalidate Operations Fee for Colusa Groundwater Authority; and Injunctive Relief, filed in this action.
2. Defendants designated as All Persons Interested* in the matter of McCullough et al. v. Colusa Groundwater Authority et al., Colusa County Superior Court Case No. CV24410 (the “Reverse Validation Action”), generally include all owners of parcels of real property and all local agencies located within the boundaries and jurisdiction of the Colusa Groundwater Authority (the “CGA”), who are subject to the Operations Fees established by the CGA, upon its adoption of Resolution No. 2019-02, at its regularly scheduled meeting on June 5, 2019. This Reverse Validation Action has been filed by Plaintiffs to obtain an order of the court invalidating CGA Resolution No. 2019-02, on grounds which include the failure of CGA to comply with requirements to submit the proposed Operations Fees to an election of all qualified voters within the jurisdiction of the agency. By adopting Resolution No. 2019-02, plaintiffs contend that CGA violated the limitations on property related fees and regulatory fees, which can be adopted by a local agency without an election.
3. ALL INTERESTED PERSONS WHO DESIRE TO CONTEST THE LEGALITY OR VALIDITY of Colusa Groundwater Authority’s adoption of Resolution No. 2019-02, which established the Operations Fees applicable to such Interested Persons, MUST FILE A WRITTEN RESPONSE TO THIS REVERSE VALIDATION ACTION ON OR BEFORE OCTOBER 4, 2019, AT THE COLUSA COUNTY SUPERIOR COURT. All Interested Persons who contest the legality or validity of CGA Resolution No. 2019-02 will not be subject to punitive action, such as wage garnishment or seizure of their real or personal property, for any reason arising from their filing of a written response contesting such legality or validity of CGA’s action.
