Shooter admits guilt, pleads to lesser crimes

A convicted felon facing 25 years to life in state prison for attempted murder pleaded to lessor charges in Colusa County Superior Court on July 24.

Rodolfo Martinez Madrigal, Jr., 28, pleaded guilty to three felony charges, including assault with a deadly weapon and use of a firearm.

Madrigal, Jr. is facing up to nine years in prison when he is sentenced on Sept 11, as recommended by Chief Deputy District Attorney Brenden Farrell.

Madrigal, Jr. admitted in court to firing the sawed-off 12-gauge, pump-action shotgun, recovered by the Colusa County Sheriff’s Department after the incident, at his girlfriend’s ex-boyfriend in front of his residence in the mobile home park on Baldson Street, in Grimes, following an altercation around 10:30 AM on Feb. 25.

However, Madrigal’s attorney, Public Defender Albert Smith, said his client did not actually point the weapon at the victim, which did not justify the original charge of attempted murder, which could have carried a sentence of 25 years to life.

“A great deal of negotiation has gone into this case,” Smith said.

Smith said he expects his client to serve prison time for the crime, but under the circumstances plans to argue for a mid-term sentence on each of the three counts.

Colusa County Sheriff’s Office officials said the victim, Alex Uribe, said Madrigal Jr. had confronted him with the weapon but admitted that he was walking away when the shot was actually fired.

Afterward, Madrigal allegedly warned Uribe that “he was not playing around,” before he jumped into and was sped away in a dark Honda sedan.

Although another resident of the mobile home park saw the argument between the two men that morning and heard the shot a few minutes later, no one actually witnessed the firing of the weapon, according to Deputy Trenton J. Beck, at an earlier hearing.

In addition to the felony assault and firearm charges, Madrigal Jr. is also facing a felony special enhancement charge for having served prison time for a previous violent felony, which could add an additional year to his sentence.

In 2011, Madrigal Jr. was convicted of stabbing a rival gang member following a St. Patrick’s Day altercation in Chico.

Colusa County Superior Court Judge Jeffrey A. Thompson accepted Madrigal Jr.’s guilty plea last week, but warned him that if he is in the United States illegally, the conviction could result in his deportation.

Madrigal Jr. has been in custody at the Colusa County Jail since his arrest. His family was present in the courtroom last week for his guilty plea. ■
